1. Timely Manor: All payments must be made in a timely manor, by check, money order, or bank draft. Cash will not be accepted. Payment Address is:

2. Prepayment penalty: None. Buyer may prepay all or part of this loan at any time, with no penalty.
3. Late Fee. Payments are due on the 1st of each month, and are late after the close of business on the ninth day of the month. A late fee of 8% of the monthly payment will be imposed on payments received after the ninth day of the month.
4. Completion of Contract for Deed: At Buyer’s option, any time after 6 consecutive monthly payments received before the 10th of the month (Late date) OR Buyer has minimum 10% down, the Buyer may request a Warranty Deed, with title in his/her name. A note and Deed of Trust will be prepared by Seller and signed by Buyer. Once recorded at the county the title to property will then be in Buyer’s name. There will be no closing costs for this transaction. *
5. Special “Red Carpet” Exchange: As long as tract is under a “Contract for Warranty Deed”, and the payments are current, the Buyer may exchange his/her equity in the tract for equity in any other tract the developer currently has in inventory (at his current sales price). Equity is defined as the total amount paid as of that date, less that portion deemed interest. Once the title to the tract has been transferred under paragraph 4 above, the right of exchange is no longer available, unless Buyer is willing to pay all closing costs.
6. GUARANTEED TRADE-IN VALUE: If for any reason, within one year of a cash purchase, you decide to trade in your unaltered property for another property of equal or greater value from our current "Property For Sale" list, we will credit the full principal amount of your original purchase to your new property purchase.
7. Property Taxes: Property taxes are the responsibility of the Buyer. If the property is under a contract for warranty Deed, the seller will provide a pro-rata tax statement by Nov 30th each year and Buyer shall pay his pro-rata share of the taxes to the Seller, by January 15th. If the property is under a note and deed of trust, payments to Seller will be increased to escrow for the property taxes. Payments may be adjusted at any time to make sure the escrow account is adequate to meet the estimated property taxes.
